I see your point, you cannot be prosecuted for being offensive, if so the cells would be full. I saw it more as hate crime is an offence and should be reported which is what I believe is the message the Merseyside police were trying to convey.

"Typical of fascist regimes, but who is paying attention to history?", possibly the millions of innocent people who suffered terribly at the hands of typical fascist regimes arguably because their leaders speech / speeches had not been made a crime.
